Former San Benito Housing Authority Director Yvette Nieto filed a federal lawsuit against Mayor Rick Guerra and board chairman Ben Cortez, claiming she was fired due to “discrimination and retaliation.”
Nieto filed the lawsuit in U.S. District Court on Oct. 24, against Guerra, his brother Jhonny Guerra, Cortez, the housing authority, the San Benito Housing Development Corporation, Community Services Corporation and the City of San Benito.
Guerra wished not to comment on the matter, while Cortez was unavailable for comment.
In her lawsuit, Nieto claims she was subjected to a hostile work environment, workplace intimidation, humiliation, discrimination, retaliation, wrongful termination and discrimination on the basis of gender.
Nieto is seeking punitive damages, including lost and future wages.
Nieto claims Guerra appointed Ben Cortez to the board to discover when she fired his brother, Johnny, from the housing authority.
Nieto fired Jhonny Guerra after her investigations into allegations of sexual harassment on his part were found to have validity.
