A San Benito man is accused of assaulting and chocking his uncle.
According to the Cameron County Sherriff’s Office (CCSO), on Tuesday, February 6, 2024, at about 1 p.m., Cameron County Sheriff’s Deputies responded to a residence on the 31000 block of PFC Juan Garza, in the San Benito area, regarding an alleged assault.
Upon arrival, sheriff’s deputies made contact with a male victim who alleged that his 23-year-old nephew, identified as Carlos Yair Martinez, assaulted him.
The subject explained that an argument between him and his nephew initially started over Martinez letting the family dog out of the residence.
The subject told deputies that Martinez then allegedly began to pick a fight with him, which led to Martinez pushing the subject. The subject said that he fell and Martinez then allegedly punched him in the face and choked him by placing his forearm around his neck and using his body to apply pressure.
According to the CCSO, the uncle reported that he believes he was in a chokehold for over 15 seconds, interrupting his ability to breath. Sheriff’s deputies reportedly observed bruising and swelling on the victim’s face, which was consistent with his statement of being punched.
Deputies eventually made contact with Martinez and placed him under arrested. He was transported to the Cameron County Carrizales-Rucker Detention Center in Olmito pending arraignment. Martinez is charged with Assault Family/Household Member, Impeding Breath/Circulation, a 3rd Degree Felony.
