Ethics complaint against mayor filed with DA’s office

The ethics complaint accusing San Benito Mayor Joe H. Hernandez of violating a conflict of interest affidavit was filed with the Cameron County District Attorney’s Office Friday morning, this after the San Benito City Commission on Feb. 7 unanimously voted to defer the case to the DA.

San Benito resident Alfonso Benavides, represented by former City Attorney Jan Cassidy, cites 11 charges as opposed to the 10 originally listed in the complaint filed to the city.

Among those is the original charge, in which Benavides alleges that Hernandez violated Chapter 171.002(2)(b) of the Texas Local Government Code when the mayor admitted in open session of a special city commission meeting last July that he had a conflict of interest pertaining to the discussion of mobile vendors.
