Eleven revisions to San Benito’s city charter recommended by the review committee tasked to research potential amendments will go before the San Benito City Commission for approval in a special meeting on Monday.
If approved, the revisions will then be placed on the ballot for the May 12 general elections for voters to decide on.
Among the changes proposed by the five-member committee is to remove the clause that says elected officials must pay all taxes due to the city. Based on former City Attorney Jan Cassidy’s interpretation of Section 3.06 (b)(1) of the charter, which states that a city commission members forfeits office if they lack at any time during their term of office any qualification prescribed in the charter, the commission recognized Mayor Joe H. Hernandez’s office as automatically forfeit in 2010 due to owing taxes to the city.
