Officials at Odds over Street Repairs

Issues of street disrepair were tabled at Tuesday’s meeting of the San Benito City Commission, this after commissioners had specifically requested three new streets be added to a long-standing Street Improvement List that dates back to 2012.

Schneider Road, Roberts Drive and Railroad Road were considered for rehabilitation at the Tuesday, Jan. 20 meeting of the city commission. According to Mayor Celeste Sanchez, “Commissioners Joe D. Gonzalez and Rene Villafranco are the ones who requested that item be put on the agenda.”

Place 3 Commissioner James D. Penny said, “If we want to put those streets on the list, I suggest that they be put on the end of the list … Streets have already been numbered. Some streets have problems with sewer and water. Those were supposed to have been done first, because there are underlying problems underneath.”

Penny said the commissioners “asked Mr. Lara, ‘When are we going to attack these (previously listed) streets?’ We still haven’t addressed that, either.”

City Manager Manuel Lara distinctly said matters of street repair are “up to the commission … It’s really up to them.”

“I would like for them to allow us to do a study,” Lara said of the elected officials. “A professional study of the streets will give us priorities of which are the worst streets. It gives you different conditions … prioritizes streets. Many cities are doing that. It’s a good software program … We do not have that.” In San Benito, the order in which streets get addressed “is more of their preference,” he added.

Regarding the aforementioned software program, Penny said he had not heard of it prior to this reporter’s inquiry. He added, “I would say the best assessment to which streets (are in disrepair) is us. We can look at them (and see for) ourselves.”

“I haven’t heard about this software,” said Sanchez, “but am open to looking at it, studying it, and if it gives us information we don’t have, I am not opposed to using something that will help us do a better job. I’m not opposed to using technology to do things better.”

“From an administrative standpoint,” said Lara, “I wish they (commissioners) would allow us to do a professional study … and allow us to go after streets in the most need … But one month, they can call a meeting and give us new streets that are not on the list. The elected officials have the authority and power to do that.”

Referencing the three new streets proposed to receive repair, Penny said, “These new streets should be put at the end of the list … Another thing to ask is, ‘Do we have the money to do those streets?’ We need to find how much money is left over in the street project. We have some (funds) from the 2012 (Certificates of Obligation) CO’s, but we need to find out how much is left, and if we can do those streets.”

“Right now, we’re trying to do the best we can,” said Lara of his administrative team. “We are taking directive from the elected officials. We can spend more money and use better materials or spend less money.”

To that end, Penny said that the commission “thought the longer-lasting (option) was best. I would rather do that. But then, of course, we get into facts that are presented (to us). For me,” he added, “I don’t like the quick fix. What I would like to see is a good job done. Just do it once.”

Lara said, “The biggest problem we’re facing is potholes. But until the weather heats up … any material we use … is going to wash off because there’s too much moisture in the ground. It will not bond.”

“We have many other roads in need of repair,” said Penny. “There is a list that exists … on another agenda … I saw we are going to add to the list … Shafer (Road) and East Stenger (Street). If the other part of the commission agrees with it, I wanted to do those first, especially Ratliff (Road). Bravo (Street) is the same way. I think it needs 1,200 feet of sewer… I’m gonna ask, ‘Are we going to do these first?’”

The previously-compiled list of streets reportedly consists of only those streets deemed in most pressing need of repair. “We picked the ones that looked the worst,” said Penny. “A lot of the streets haven’t been paved since the 70s.”

Some members of the community have raised concern, making reference to the fact that at least two streets that have received repair are home to commissioners and/or their family members. Lara said, “You know, sometimes you need to listen to the community. From my administration standpoint, I wish that they (commissioners) would allow us to do a study … and then just go after it … in a sequence that meets the priority of the most need that we have.”

“I am going to address that we should stick with the plan we have, and if we have funds to add those (three proposed streets) that they be added to the end of the list,” said Penny.

Lara said of the city’s street disrepair, “There’s not much we can do … We’re here to follow the instructions and directives of the elected officials.”

A special workshop to prioritize street repairs will be held at the Municipal Building on Feb. 2, at 6 p.m. Sanchez said elected officials will “look at the existing list of streets and add to or delete streets.”

    WOW! is not the first word that came to my mind when I read what (up for re-election) Commissioners Joe D. Gonzalez and JD Penny are now proposing.

    I took a quick peek at the Commission Agenda for Tuesday night on the San Benito web page and this is the agenda item found:

    15. Discussion and possible action on accepting Schneider Road as a city public right of way street.

    Just four months ago (January 2015) Commissioners Joe D. Gonzalez and Rene Villafranco attempted to get the city to repair Schneider Road (a private road).

    Since that didn’t fly because they are PRIVATE ROADS, now Commissioners Joe D. Gonzalez and JD Penny want the city to accept Schneider Road as a public right of way street and have the taxpayers pay for the paving and installing the infrastructure (sewer, etc) on a private road. Since the El Ranchito RV Park was built way back when, my guess is it is not even platted. This will mean it will need to be platted at taxpayer’s expense. They will probably also want the street widened with street lights; at taxpayer’s expense.

    Bear in mind that Schneider Road is a one-way road that serves as the entrance to the El Ranchito RV Park. How can this private road that benefits only the residents on Schneider Road be considered a public right of way street?

    If this is approved, it will definitely set a precedent. Up next will probably be Roberts Drive and Railroad Road (both private roads) and any other private road with connections to a member of the city commission in the city of San Benito. The allegation is that a realtor was the one who requested Roberts Drive be repaired by the city. Railroad road is also an entrance to another mobile home.

    I find it completely unfathomable to me that these two commissioners (JD Gonzalez and JD Penny) who are up for re-election would even consider such an action.

    Why not stay focused on the residential streets that have already been identified as needing lots of work? I am completely disappointed in these two commissioners. I wonder what else they have planned if they get re-elected.

    San Benito will never change until the citizens or voters change it.

    San Benito deserves better than this. Accountability, Honesty, and Integrity are sorely lacking in San Benito and it will only happen if the voters demand it.

    I don’t understand how you can criticize certain politicians when the ones you support are worthless. This newly elected board members are the worse ever and you supported all of them except Fatima Huerta and Yiliana, and the reason is, you can’t control or manipulate them. You have lost total credibility with everyone except the Tumberlinson’s because you worship the ground they walk on and they use you. Ana Cruz will lose 2015..

    At children’s side: you sure seem to have a vested interest with Ms. Huerta not getting elected.
    Gonzalez is finally doing something because this election matters to her. She should never have been reelected…. Remember the insurance letter and her “friends” at the main office helping with this issue.
    Sure hope San Benito finally wakes up.

    Back to the issue of the worst streets in the entire valley: just yesterday I went to the San Benito post office, and in driving through that aweful street I went through so many bumps in that road that my rear view mirror fell from my windshield. And it is not that it is not a well made vehicle – it is instead that you practically need a 4×4 vehicle to go through some of the streets in this town. Talks of renovating Stonewall Jackson to attract tourism – how about fixing our streets already so that when these “tourists” visit San Benito it feels like you are actually driving in a street in America and not some third world country.

    To Exposed: Glad people are becoming involved and have formed a forum like CAVA. I never did receive a phone call from the “State” or anyone regarding possible voter fraud as was mentioned over and over in the blogs months after the last school board election. Never received a call from elections office in Brownsville because there was nothing to investigate. Period!

    Oscar Medrano has been in the past awarded and recognized as outstanding board member by TCTA. First school board member from SB to earn the distinguished title “Master Trustee” designation. Past president of Resaca Fest, United Way, etc. etc. Graduate of Texas State University.

    I agree with your first comment pertaining to Ana Cruz’s shenanigans to get what she wants, simply pathetic.. Yiliana has made her mistakes but she’s the only one fighting for our children and staff now.. This new board has done much worse than she ever did and wasting tax payer dollars.. I’m sorry but Fatima does not fight for anything nor has a voice, she just hides behind her vote.. We need thinkers on the board and not politicians who are more concerned about promoting their own family… By the way, Ana Cruz and Fatima Huerta will definitely lose .. Please someone tell that person -Rosalinda- to stop commenting.. She’s the joke of our town… 2015, the good politicians will win….

But who are we kiddn, these board members are all about fulfilling their promises that got them elected plain and simple. In a perfect world unity is the key to success.     Ana Cruz worked for dr alaniz when he was supt in SBCISD. He did the supt search that brought in a supt from one of the smallest districts in the state…, research that.
    Ana and mrs Rodriguez-Gonzalez will not get elected…. Watchers are watching this election.
    Fatima will get elected…she has our support. She does not put on that she is better than everybody else like some board members.

She supported Oscar Medrano, one of the biggest jokes of the board the past several years.. Great example of politicians you support.. Now you support Ana Cruz, please she is nothing but a selfish politician who’s there for her personal gain. Remember her husband Orlando Cruz!! She walking in the same foot steps. We are tired of these people and we will come together and make sure this election is not rigged like the last school board election..     To Denny Crane:

    I would add Yliana Gonzalez Rodriguez or Rodriguez Gonzales to that list of voting them out. Thank goodness she was stopped from the board voting to hire that energy saving company she was pushing for that would have cost the district over 10 million dollars! Entegral Solutions. I too am tired of some elected officials/members wanting to make recommendations that are not in the best off the district/city. I am ready to finish the battle and get educated, responsible, competent, thinkers; strategists, problem solvers, decision makers, board members elected.

    BTW:

    I am confident the board made an excellent choice with hiring Dr. Puig. It was Ana Cruz that researched and recommend the consulting company. Way to go Ana Cruz!

    What a solipsistic view.

    It does not “appear” but is indeed a fact that these private streets are for the benefit of the property owners and RV’er and winter residents of these mobile parks. The issue is NOT “access” to the property but the condition of the private roads. These mobile home parks have more than one entrance/exit to the parks.

    Maybe the property owners can take this “BIG MONEY” you allude to and repair their own private roads. Whoever developed the mobile home parks is the one RESPONSIBLE for the roads. PERIOD.

    Citizens and taxpayers of San Benito ALSO bring in money via their property and sales taxes to our community. However, I don’t see the city repairing or paving “private driveways”. The majority of citizens in San Benito do not have the disposable income to own an RV much less afford a winter home.

    As fed-up residents, we “ARE” coming together and doing whatever we can do to improve our community. Uppermost is to rid the the City Commission of commissioners who are obviously looking out for their friends (Cruz-Hogan) and willing to spend the taxpayer dollars for the benefit of a few (mobile home parks).

    Similarly, the members of the School Board who have also shown that “educating the children” is secondary to their own accomplishments should also be replaced.

    The use of taxpayer funds by the City Commission for the benefit of “private use” is not only morally wrong but illegal. The members of the City Commission have a fiduciary duty regarding the management of “taxpayer monies.”

    If we can’t VOTE THEM JD Penny, Joe D. Gonzalez, Ana Cruz, Fatima Huerta OUT,,,,,,,,,,RECALL them Rene Villafranco!

    We need Integrity & Responsibility! Not Compadrismo or recycling of past politicians!

    @Life Long Citizen and all San Benito Citizens – I do and I will stand with you to replace those who use and abuse the powers, you have given them. That is a must! As residents, we must make time to get involved – we must educate ourselves on the issues and be willing to work toward the solutions. Imagine what San Benito would be like if, we the residents came together. I know I am the newcomer but you need me and I need you if we want to see things change!

    Always a step or two behind. Instead of complaining about what is happening with the city or school district after it is has happened perhaps people should be more proactive and attend meetings and address concerns before they are addressed.

    Persistent action > endless complaining

    I agree with your comment but call a spade a spade. We’ve been paying taxes for years and years and these street still get ignored. I can calculate how much money I’ve paid in taxes over 40 years. That’s gives me a right to voice my concern as a life long citizen of this community!! Come together please, these politicians are there for self gain and that’s the dam problem who you kiddn… Politicians need to be held accountable in the city and school in order for our town to move in the right direction.. Election 2015, Joe D, Penny( city commissioners ) out, and Ana Cruz and Fatima Huerta ( school board ) out…. We’ll come together and make it happen, trust me…

    There should be a criminal investigation! How do these things happen?? This has to be a conspiracy.
    If you know anything about San Benito history and politics, you know that Railroad Road is one of those so-called streets that comes up ever so often. Someone keeps pushing some elected officials, (and City administrators) to get this street paved; FOR YEARS! What is the connection?? Has someone put up money or political favors on the table in order to entice City officials to make this happen??
    Thank you Mayor for resisting and not accepting this obvious political ploy while our central city remains full of potholes! Do we have a City Attorney??

    It “appears” these streets are for the benefit of the RV Parks but guess…. RVer’s and Winter Texans staying at those parks bring in big money to our community; If they can’t get to the parks, they will go somewhere else. I see signs that is already happening here in San Benito. We need to see the bigger picture. As residents of this city need to come together and start doing whatever we can to improve our community. Stop letting our dogs run loose, pick up trash along the streets, Help neighbor get their property cleaned up… maybe we would have more city resources for street repairs.

    They’ve been fixing roads that are pretty much out of the city limits, could it be the favors tthe owe someone. When will my street be fixed sb commission? We still have these old un leveled concrete streets, do something about it or the people will come election time

  8. I agree with your comment pertaining to not re-elect Joe D Gonzalez but you have to add Penny to the list because his a puppet. It’s simple, these commissioners do not do anything without it benefiting them, so there must be something there for them to gain. Those RV parks produce votes and it’s time for re-election. Joe D is so predictable that’s why his not a superintendent anywhere people, if he can’t run schools what makes you think he can run a city.. This is exactly the results when Joe D is involved and it needs to stop!! Let’s take our city back and get ride of these idiots..

    These streets may not even belong to the City! How could these 2 commissioners put streets on the list where no one lives while so many of our core City streets are a mess!
    This smells of compadrimso. In fact, it STINKS!

    1. These are dead-end Private Roads/Streets, Schneider and Railroad are entrances that abut by Mobile Home parks.

      SCHNEIDER ROAD GOOGLE MAP surrounded on both sides by Resaca Bend RV Park and El Ranchito RV Park.

      RAILROAD ROAD/AVENUE (Satellite View), This is a private road that leads to, you guessed it, the private entrance to The Tropics Mobile Home Community.

      ROBERTS DRIVE (Satellite View), a private Drive just on the North side of Resaca Shores across the Resaca.

      The citizens of San Benito need to take the “Heather Hopes” commentary: Reclaim Your City! to heart!!

      1. CORRECTION/UPDATE: RAILROAD ROAD/AVENUE (Satellite Earth View), This is a private road, MAP VIEW” that leads to, you guessed it, the private entrance to The Tropics Mobile Home Community.

        This road most likely also falls within the Union Pacific Rail Road Company easement which would cost the city MONEY to obtain the property. If I remember correctly, the city previously did some work on this particular road as a result of or “recommendation” (wink, wink).

        It just gets better and better!
