BREAKING: Suspect accused of trying to run over officer charged with attempted capital murder

The man accused of attempting to run over a San Benito police officer was apprehended by local and federal authorities on Thursday.

The suspect in question, Cresencio Esquivel Lozoya, 35, of San Benito was arrested at approximately 9 a.m. Thursday, Oct. 24, San Benito Police Department Detective Rogelio Banda Jr. reported Friday via press release.

According to Banda, federal authorities assigned to the U.S. Department of Homeland Security assisted SBPD investigators in Lozoya’s apprehension, which occurred during a traffic stop in the vicinity of Hutto Road and Expressway 83 in Donna.

Lozoya was wanted in connection with a Sept. 11 incident in which the suspect and three males, who as of yet have not been identified or captured, were accused of using a motor vehicle to assault SBPD officer Joe Ledesma, specifically by driving their Buick Sable toward the policeman in an alleged attempt to run him down. The incident occurred in the vicinity of the 500 block of S. McCullough St.

Ledesma reportedly opened fire on the vehicle, shooting at least five times, SBPD Operations Chief Martin Morales Jr. has confirmed. Morales has also said that Ledesma, who was placed on administrative leave pending the outcome of an internal inquiry into the incident as per procedure in such cases, fired at the vehicle because he felt his life was threatened.

Banda said Lozoya, who was charged with attempted capital murder, evading arrest in a vehicle, evading arrest on foot, possession of marijuana in a drug free zone and duty on striking, is currently incarcerated at Cameron County Jail on $135,000 bond set by Precinct 3, Place 2 Justice of the Peace David Garza. Police also confirmed that there’s an immigration detainer on Lozoya, which was issued by Homeland Security investigators.
