Man arrested for injuring kids in car crash

Jose NietoA San Benito man was arrested Sunday for intoxication assault, this following a car accident in which his three small children were reportedly hurt.

According to Lieutenant Martin Morales of the San Benito Police Department (SBPD), 32-year-old Jose Nieto was arrested at approximately 3:27 a.m. Sunday, Aug. 28 after he allegedly crashed his car, with his wife and three kids in tow, into a pickup truck at the intersection of South McCullough and Cash Street.

Responding to the accident was San Benito Police Officer Juan Velez along with other patrolmen.

Authorities on the scene said Nieto was driving a four-door Mitsubishi on Cash Street that collided into a Chevrolet Silverado pickup truck traveling southbound on McCullough. The driver of the Silverado, an unidentified male, suffered a minor injury to his elbow.

Nieto, his wife and three children, ranging in age from 2 to 10 years old, also sustained minor injuries. The children, however, were transported to Valley Baptist Medical Center in Harlingen for treatment. Officers reported that the kids have since been released.

“The driver (Nieto) spontaneously stated that he had drunk about six beers,” Velez said. “Assisting officers then detained the driver and performed several examinations, including an FST (field sobriety test). We also took a breath sample for alcohol analysis.”

Nieto was then promptly arrested and later charged with three counts of intoxication assault, this due to the children being injured, Velez said. Nieto was transferred to Carrizales-Rucker Detention Center in Olmito on $15,000 bond – $5,000 per count.
