Hernandez seeks to regain mayoral seat

Former San Benito Mayor Joe H. Hernandez announced his candidacy for the 2011 May elections on Monday, Feb. 14.

“Today is the very first day for filing, and right after here I’m going straight over there to file,” Hernandez said early Monday morning before remarking on the manner in which his office was left vacant in early 2010. “I think my terms were kind of cut short. There’s unfinished business as far as the city goes.”

In January of last year, Hernandez involuntarily forfeited his office as mayor after the city commission, acting on the advice of City Attorney Jan Cassidy and citing city charter language which states an elected official forfeits their office if at any time during their term they owe back taxes to the city, unanimously voted to recognize as much. What has since transpired includes various litigations in state and federal court in which Hernandez has sought temporary restraining orders and injunctions to prohibit the commission from filling his seat and to return him to his post.

Hernandez said that his intentions for reelection are to continue his work prior to the forfeiture of office. He said that he plans to continue improving the quality of life in the community and completing unfinished projects he said are still pending finalization.
