RANK ELIMINATED: Commission removes fire marshal post

City of San BenitoThe San Benito City Commission voted Tuesday to eliminate the rank of fire marshal in a unanimous vote.

Ordinance 2485 previously died due to lack of a second motion at a previous meeting. After its approval at a regular meeting on June 5, the ordinance authorizes assigning fire marshal duties as job functions as per Civil Service law.

During Tuesday’s meeting, the commissioners convened in executive session to decide the ordinance. Afterwards, Place 4 City Commissioner Joe D. Gonzalez made the first motion while Mayor Pro-Tem Tony Gonzales seconded.

It remains unclear which firefighters will be assigned fire marshal duties.

  1. Just a quick observation!

    I was told by City Administration that the position of Fire Marshall would remain a “Civil Service” position.

    My understanding is that a Civil Service position is afforded due process and must have just cause for termination.

    However, the new Ordinance #2485 Section 4 reads as follows:

    “Assignment Is At Will. The assignment of the Fire Marshal’s functions and duties is an at-will assignment and may be removed and re-assigned at any time by the Operations Chief.”

    Categorizing the position as a Civil Service position and having Section 4 inserted in the Ordinance is in my opinion an “oxymoron”!
