Alleged assault investigated

LOZANO, TX—According to the Cameron County Sheriff’s Office (CCSO), an area woman allegedly suffered extensive injuries at the hands of her uncle.

According to a CCSO report, on Sunday, January 7, 2024, at around 2:30 p.m., Cameron County Sheriff’s Deputies responded to a residence on the 29000 block of Strong Street in Lozano in reference to an alleged assault.

Upon arrival, Cameron County Sheriff’s Deputies made contact with a 26-year-old female who showed visible signs of injury and assault, deputies reported. The female explained to the deputies that her aunt brought over the aunt’s children so the woman could care for them. She then reported that her uncle, later identified as 40-year-old Eduardo Herrera, arrived to her residence, allegedly intoxicated, and asking to take the children with him, according to the sheriff’s office report.

The female told deputies that she refused to allow Herrera to take the children due to his suspected intoxicated state, which caused him to become agitated. The victim then said that Herrera stepped out of his vehicle and began allegedly assaulting her by striking and kicking her multiple times causing various injuries.

Emergency Medical Services were called to the scene and subsequently transported the female to a local hospital where it was determined that she did indeed sustain serious bodily injuries requiring extended medical treatment.

Sheriff’s deputies obtained statements from witnesses describing the alleged assault and learned Herrera fled the scene prior to the deputies’ arrival.

Sheriff’s Investigators contacted hospital staff and were informed of the severity of the victim’s injuries. Based on the information gathered throughout this investigation, sheriff’s Investigators obtained an arrest warrant authorizing the arrest of Herrera for the offense of Aggravated Assault.

Incidentally, the San Benito Police Department had arrested Herrera on unrelated charges and he was subsequently transported to the county jail.

Sheriff’s Investigators served Herrera with the aggravated assault warrant while incarcerated at the county jail. Herrera is charged with Aggravated Assault; TPC 22.02, a Second Degree Felony.
