Public hearing set for Reagan rezoning

The City of San Benito Planning Department is having a public hearing for property owners within a 200-foot radius of a tract of property for which a rezoning application has been submitted.

Set for 5:40 p.m. Thursday, Nov. 20, the public hearing will be held in the City Annex Municipal Building #2 on 400 N. Travis St., where officials will request input from the community about the proposed rezoning of 401 N. Reagan St. from single family to commercial restricted business.

A planning department notice reads the following: “Public hearing and take action to rezone from a ‘Single Family – One (SF-1)’ zone to ‘Commercial Restricted Business (C-1)’ zone, located at 401 N. Reagan St., bearing a legal of San Benito 3rd Addition, Lot 7, Blk. 31 and located at 387 N. Reagan St. bearing a legal of San Benito Original Townsite, Lot 12, Blk. 35, City of San Benito, Texas. Applicant: Alfonso De La Torre.”

Interested parties may appear in person or by attorney to show cause for or against the rezoning permit request, the notice further read.

According to City Planner Rodrigo Davila, this application was filed because a home on the lot became “one or two apartments.” Davila said someone has since purchased the property “and his intent is to improve them.”

“Honestly, it’s already been operating as such,” said Davila. This is just a move to try to get the facility in compliance.

“It doesn’t automatically become a business [if they rezone],” said Davila. What it will mean is that “there will be a different set of inspections” for the property, which will not be commercial.

Such action would mean the facility, to meet inspection criteria, would “demand … better pipes, a better roof, more parking accessibility,” said Davila, adding, “it just gives him [the owner] the ability to do that.”

That’s the proposed plan for the applicant, according to Davila.

Anyone within 200 feet are going to be directly affected, and a city ordinance states that all property owners within the area must be notified and encouraged to speak on the matter – for or against.
