Lawsuit alleging conspiracy in federal court

Now it’s in the hands of a federal court.

Though originally filed in the 357th State District Court in Brownsville, San Benito resident Alfonso Benavides’ lawsuit alleging local police of false imprisonment, malicious prosecution and conspiracy will now be heard in U.S. District Judge Andrew S. Hanen’s courtroom, according to representatives of both the defendants and plaintiff.

Details on a court date, however, were unclear as of press time Friday.

Filed on May 7, the lawsuit names Benavides, 60, as the plaintiff and the defendants as the City of San Benito, former Mayor Joe H. Hernandez, City Manager Manuel Lara, San Benito Police Department Operations Chief Martin Morales Jr., Assistant Operations Chief Michael Galvan, Officer Greg Monroe, Detective Michael Cortez and Sergeant Isaac Vasquez. Also named as a defendant are Justice of the Peace David Garza and San Benito resident Antonia Weaver.

The suit specifically alleges that Benavides was falsely imprisoned and victimized by malicious prosecution, conspiracy, negligent and intentional infliction of emotional distress. The accusations stem from Benavides’ May 2012 arrest for allegedly harboring a runaway, a charge which was dismissed by the Cameron County District Attorney’s Office in June 2013.

As previously reported, Benavides seeks damages for injuries sustained in the amount of $1 million for each charge.

  1. I agree but you can say the same for a few board members and commissioners as well. It’s a trend in San Benito to elect people with no jobs to school board, really, what kind of example are you setting for our children.. But than again, only in San Benito.. Our politicians have turned out to be a huge joke these days.. God help SB!!!!

    Let’s see how it unfolds. During Joe Hernandez’s regime there was a lot of shenanigans. Let’s see what this lawsuit brings out. Hopefully the people responsible for any dirty tricks will be held accountable. The Federal courts should be more even handed than the State court system and less prone to be sympathetic to the whining of the politicos Maybe, just maybe the some of the truth will come out. Wow! What a concept…the truth!!

        Hey Denny. as we all know…NO ONE DID. But to be filing frivolous lawsuits, being a nuisance in the community to include the school dist. and then want to get reimbursed funds for emotional distress…FFFUUUEEE…!!! that doesn’t sit well with me. That’s how those charges got BESTOWED on him “for walking the streets” lurking…ready to pounce. Look into his history and past then you’ll agree with me. Thing is he’s always supporting (POLITIQUERO) certain candidates that run for office (which is his right), but then IF THEY DO WIN….HE THINKS AND FEELS HE’S THE ONE THAT HAS THE AUTHORITY AND SAY SO and he feels BESTOWED to want to council people and reply with ” I’LL SEE WHAT I CAN DO “…again WHAT A GOOFBALL….
