SBCISD employees allege harassment

SBCISDThree longtime San Benito CISD employees alleged on Monday that they’ve been targeted for harassment due to their political leanings.

Debi Smith, 58, Gladys “Patty” Garcia, 37, and Felix Almaraz, 28, have a combined 58 years experience working at the school district, but they fear their tenures may not last much longer as a result of what they called “political changes” that have taken place since the May 2012 general election.

Specifically, the three employees, who were open about their political support for school board candidates Bob Tumberlinson, Anna Llanes and Dr. Wilma Garza Smetter last year, attributed various alleged incidents that – since May 2012 – include a tire slashing, a stolen iPad and harassment.

Smith, who’s worked for the district for 38 years – first at San Benito High School and now at the Public Education Information Management System (PEIMS) department, said, “I’ve been openly supporting my candidates, I poll-watched during elections for different candidates and campaigned for them. I’ve been doing this for years, but I was never in fear for our jobs like I am now.”

According to Smith, her overtime has been cut and has been recently informed that she could not work unsupervised – happenings she attributes to political maneuvering.

“Everyone else works unsupervised,” Smith said. In a letter to the editor that Smith, Garcia and Almaraz submitted for the Feb. 20 mid-week edition of the San Benito News, Smith said she took particular offense to a sign Jesus “Chuy” Aguilera, owner of Chuy’s Custom Sports and father of Board Secretary June Aguilera, posted during last year’s early voting period.

“During early voting on May 2, 2012, Jesus Aguilera, the owner of Chuy’s Custom Sports, stood across the street of the Tax Office (where early voting was taking place) wearing a large shirt and (had a) large sign that read something to the effect that they had to put a white woman in there because the two Mexicans could not handle it,” Smith said. “That, to me, is a racial comment that was visible to early voters and the employees in the Tax Office.”

“She was offended by it then, but you know what … if she was offended by it last year why didn’t she tell me about it last year?” Chuy Aguilera said. “If she wants to be offended, that’s fine. She can be offended all she wants. They’ve gotten away with a lot of stuff, and it’s like I tell my daughter, don’t look at what happened in the past but what’s happening in the future.”

Chuy Aguilera also said he doesn’t wish for Smith, Almaraz and Garcia to be terminated. “If she thinks I’m after her job, she’s wrong,” he said. “It’s her own people in the administration building that have put the finger on her. They all think I’m after them, but I’m not. I’m just tired of getting phone calls saying, ‘Did you know she came in at 1 p.m.? Did you know she wore chanclas? Did you know she wore jeans?’ You tell them to do their job and be held accountable; then they will have nothing to worry about.”

However, Smith stated in her letter that her work hours were approved by her immediate supervisor, Joyce Taubert, and Superintendent of Schools Antonio G. Limón.

“Due to my husband’s critically ill health in the CCU of the hospital, I could only visit him during certain hours,” Smith said. “Joyce Taubert, my immediate supervisor, and Mr. Limón approved this arrangement of my work hours. My work performance did not suffer because of this arrangement.”

“But what happens to the other people who’ve asked and were denied?” Chuy Aguilera questioned.

Garcia, an 11-year employee of the district who currently serves as payroll clerk, recalled alleged incidents involving her tire being slashed while at SB Wings the evening of Election Day last May – which she attributed to political opponents – and what she described as a threat from supporters of her candidates’ opponents.

“‘You are so out of there,’ they threatened me that way when they found out they won,” Garcia said.

In addition, Garcia said her iPad containing an email she sent to the superintendent was stolen from her desk at work and returned the next day with the message showing that it had been read. Garcia further alleged that she’s had her picture and video taken at the administration building in an effort to prove that she’s talking instead of working and that her work attire – jeans and sandals – were inappropriate. Also, Garcia said she was notified by her immediate supervisor, Business Manager Emma McCall, that she was being “watched on the time I come in to work, the days that I am out, and basically telling me that they, specific board members, are trying to find reasons to fire me.” Garcia did not identify which board members she alleges plan to fire her.

Almaraz, who’s worked for the district for 10 years – first as a security guard and now as a grant liaison in the federal programs department, said he, too, was spoken to by a supervisor, in this case the superintendent.

“(Limón) met with me in the Human Resources Conference Room to tell me that due to political changes certain school board members were questioning my work habits along with two other employees named Patty Garcia and Debi Smith,” Almaraz said. “He stated that it was reported that we are always talking in the hallway, coming in late, leaving early, missing work and basically they were keeping an eye on us because they want to know what we are doing. He said that specific board members were pressuring him to fire the three of us. He advised me to not give them any reason to question our work habits.”

Almaraz said there have been times when he, Smith and Garcia have arrived to work late but alleged that other employees have not been notified of as much. “Everyone does it, everyone shows up late sometimes,” Almaraz said. “But we’re the only ones that there’s a problem with.”

Limón said he did have a conversation with Almaraz and further noted that Garcia and Smith’s department heads did the same with them.

“I told them they needed to be on time to work, that they needed to not have overtime unless it’s approved by their supervisor, which is a valid reason,” Limón said. “The only reason I spoke to Almaraz directly is because his supervisor (Dr. Margarita Greer) was out of town.”

In the meantime, Smith, Garcia and Almaraz said the “report on personnel” agenda item scheduled to be discussed in closed session by the San Benito CISD Board of Trustees on Tuesday was in regards to their employment, matters they continue to believe are politically motivated.

“It’s freedom of speech,” Smith said. “It’s my right as an American to support who I want and not be retaliated against because of who I support, and I don’t chastise anyone else for who they support.”

    If that was the case that you where very open about who you supported and your familiy. An you where being watch and move around, treated bad for you political support then “WHY?” Didnt you do something about it. Hello, abously you where and still—>scared to say “Who” you are (OLD TIMER) and if you where put thru that like you said you did for many years then, Where the Hell didn’t you speak out like this 3 employees that went and brought it out, (Not in chisme buy PUBLiC NEWS paper) plus this 3 employees I’m sure they have evidence of written incidents,and witness to back up there story. Why didn’t you come out in public news paper and if you had been very open about who you support you and move around, treated badly for your right to support who you want as your political pull at that time, then I guess; one you didn’t know the law & if you didn’t know the law back then you still don’t know the Law and your rights now.

    This new board members have very vindictive supporters who elected them for their own personal favors. Iliana never answers media questions and goes after employees who did not support her., She fired Ohalan because he wouldnt fire her opponents husband. It is a matter of record that she instructed them and did not like their response. Voters you get what you asked and now got to wait for next elections and see if it is not rigged.

    A most ominous sign of a debacle in both the city and school district elected officials’ present-day actions stared the community in the face, but few realized the importance of this event. The sign, you ask, is the failure of candidates to attend candidate forums. A candidate forum demonstrates to the candidates that your community cares about what the candidates’ positions are and the election outcome. Candidates for public office have a solemn responsibility to stand before the people and discuss their ideas to address our country’s challenges. It stands to reason that if only one candidate agrees to attend, it is no longer a forum. So, what excuses did the no-shows offer? “I couldn’t attend cause that was the night of my monthly dinner with the Governor.” “Oh, I missed it cause that’s the night I wash my hair.” “I just couldn’t find a babysitter.” “Uh, let’s not make the illiteracy problem even worse than it is.” Ridiculous!!! Yet, the majority of voters gave the no-shows a “pass.” On another note, should elected officials be held accountable? When an elected official declares himself/herself beyond criticism, and demands that his/her handling of public matters be kept confidential, and then accuses those who criticize him/her of misquoting or misinterpreting his/her actions, then that elected official has become a tyrant. Elected officials are supposed to be servants, not overlords; and therefore, their job performances are supposed to be subject to review and even criticism by the electorate. Stop criticizing the illegal and unethical actions of elected officials? IN A PIG’S EYE.

    My goodness!! This is so sad! San Benito CISD has really hit the bottom of all!!
    It is an extremely embarrassing moment for all of San Benito!!
    I know that politics is everywhere and things are not perfect in other school districts, but my gosh SBCISD wins the ultimate prize for most embarrassing, most corrupt, and unprofessional district in the entire state and possibly the nation!!

    chuy – get lost, along with all your other friends that are destroying SBCISD!!

    One thing’s for sure…if in 2014 all these uneducated, corrupt people are elected AGAIN, I will then realize that it’s not just chuy and yliana and the rest of their clown posse that are the problem! I will come to the realization that “I” live in a city where the majority of the voters/people are as screwed up as they are, and that will be my sign to get as far away from this town!! How could any educated, professional person think that San Benito is the ideal place to live and raise a family!! This is truly very sad! I am in awe and speechless!!

    The phone # attributed to “Chuy” is a T-Mobile cell #, not a landline. If that really is June’s father, he is very brazen — and stupid! If these 3 employees file suit, they can name him personally for harrasment, as well, then get the call records for that #. The records will reveal all the info needed to identify the person(s) calling from the admin building on work time to stir up trouble. Did I mention stupid? Even if he changes his # today, those phone records are still memorialized. These employees should get an attorney quickly to protect themselves. Stupid and brazen! Chuy and the Gang of Four.

    Before it’s over with these people are really going to stink up the place! My opinion of Anna Cruz has totally changed. She has more integrity that the whole lot of the others. How embarrassing.

    Maybe that board member father needs to remember that Mexico is south of us. we live in the best country, the USA.
    I hope those four board members know that cameras are watching. Dinners are being paid for and everything is available.

    These employees are to be praised for standing up for being mistreated. Pay attention SBCISD employees! This board of 4 with the NEW BUDGET Consultant will cut staff, programs, student travel and future pay raises. I would not be surprised if they lose quality staff members this summer. Who would want to work in a district where favors are made and good teaching is ignored? As a parent and taxpayer, my family will be watching the games these 4 board members are playing. We will not stay quiet come May 2014. We pray for these 3 employees.

    WELL WELL WELL-maybe you can get a little taste of how it feels to be watched all the time and be moved around for political reasons. I was very open about who I supported in the past and I was treated badly for many years and my family also had been treated badly for many years; it would have been nice if Mr. Limon would have spoken to me and warned my like he is warning these employees. The tables have turned; our district is a JOKE and its a shame because we have very talented teachers and students that are willing to make a difference in our district and we keep going in circles WITH no guidance from the TOP; School board members in the past and present have not moved our district forward and about the administration office-it has been out of control for years, with employees doing whatever because of their political support BUT that is politics for you. I’m so glad my grandchildren are going to IDEAS and Harlingen School District and BUT deep in my heart I still feel bad because my grandchildren had to go to another district ; I love San Benito; hope it changes soon.

    Good point, Fed Up. One could make the case that Chuy has a vendetta against these individuals and his daughter is abusing her power as a trustee to help him retaliate. Of course, she cannot act alone, and the fact that these individuals may have been discussed in executive session would show that she has at least one accomplice. We all know it’s the gang of four. The only reason people would call him about the actions of these employees, since he has no standing with the SBCISD, is because they know he has a vendetta against them; probably solicited the callers info. Easy to find out. These three need to seek an attorney’s help.

    why would anybody call chuy to make him aware of what goes on at the administration buildIing?who is chuy?i haven’t seen his name on the school board members roster or anything pertaining to the district.and to these people calling him complaining about sandals and jeans im not gonna say chanclas because i dont live in mexico even though it feels like i do because of how this man is trying to gain control over territory that does not belong to him or concern him just like the cartel in mexico.of course,he will never be no where near as powerful as they are.poor chuy!he can only dream!anyways,to these people complaining i bet you have been late many times but you think that you are excempt because your part of chuy’s clique.well i hate to burst your bubble but enjoy this all you can because next election chuy and june and iliana and the huertas are gonna be powerless and youll are the ones that are gonna be in the same place patty,felix,and debbie are.

    Superintendent warning employees about their jobs, employees believing that they are the target of a witch hunt, and another denying influence on the board. Many out there enjoy seeing others in misery. Some might even say, better you than me. Some day everyone involved in this elementary school level drama will come to the realization that everyone involved is somehow going to suffer a setback. Who’s to blame? The same persons that placed these people in their positions. San Benito is no different than any other city in Texas. San Benito only desires to air their laundry for all to see. The entire governing body governed by and believes in rumors and half-truths.

    These emoyees might be rightful in their assessments and fears, but they did the right thing in making the public aware in case they endure further persecution.

    I noticed that Chuy didn’t state to the SB News reporter that when he alledgedly received random calls from School District emoyees, that he woulf ask them why they would be calling him, instead of the Human Resources Dept. It’s apparent that he welcomes and entertains these calls, but what is most troubling is the question on why would employees allegedly call him to begin with?

    Several bloggers have stated they have seen Chuy repeatedly at administrative offices. I hope this practice has been ceased, and that he is hereby treated as a vendor or as a visitor and required to sign in and out.
