Corpse mishandling ‘unending nightmare’ for family

The David vs. Goliath battle of a local family’s ongoing fight against one of the largest funeral service providers in the nation has taken its toll, but it’s also prompted a closer look at Texas graveyard regulations and even attracted national attention.

As previously reported by the News in June of 2007, San Benito resident Marcos Guerra’s death on Oct. 5, 2001 left his family grieving, but no one knew then what would transpire next. It was a sudden and painful experience for his widow, Juanita G. Guerra, and his three daughters, Julie Guerra Ramirez, Gracie Little, and Esther Guerra Martinez. Marcos was buried at Mont Meta Cemetery on Oct. 8, 2001, but after eight years he is still unable to rest in peace, his family said.

“After we buried (Marcos), a month later my daughter was called from the cemetery to let us know that they had buried him in the wrong plot,” said Juanita. “So we had to make the decision whether to take him out and move him to another place because that plot belonged to another family. Well, I didn’t want to go through another burial.”
